FAQ's

Answers to your questions and concerns

What is a McKenzie Friend?

a person who helps you to understand the court process, prepare your case, and helps you present it in the court. They will accompany you into the court hearing and take notes and give quiet advice. They do not speak for you but will help you prepare what to say. A fuller explanation can be found here

Mediation is process by which two people who do not agree are helped to reach agreement by an impartial third party, the mediator. In Family mediation, the goal is for two people whose relationship is over to reach agreement about caring for their children, and/or about division of the family home and finances. A fuller explanation can be found here

Yes. Financially it is much cheaper than going to court. There is a Government voucher scheme worth £500 per family, and for those on low incomes, Legal Aid may be available. In general, it is also a much better way to reach agreement for you and your children, as the court route tends to increase the conflict. A fuller explanation can be found here

Yes; increasingly people represent themselves in the family courts, choosing to be what in legal terms is called a ‘Litigant in Person’. The high cost of employing a lawyer is the most common reason.  in fact, in 2025 more than 80% of family law cases had at least one person representing themselves. For most, going to court as an LIP is a very new and daunting experience, and we suggest it is wise to think your options through carefully – there are cheaper options than lawyers. In most cases, parents can agree arrangements for the children themselves or with the help of mediation. If agreement isn’t possible, the court will make decisions based on what’s best for the children’s welfare. We can help you understand both Mediation and court alternatives, and to decide what best in your circumstances and how to put your children’s needs first. Click here to book a free consultation

Not always. It depends on your financial circumstances, your children’s needs, and what you and your ex-partner can agree. Sometimes one person stays in the home, sometimes it’s sold, and sometimes it’s kept until the children are older. We can explain your options clearly so you can plan ahead with confidence. Everything from savings and pensions to mortgages and credit cards can be divided in a divorce. The aim is to reach a fair outcome based on both partners’ needs. We can guide you through what assets are included, how they might be shared, and how to protect your future security. There are different ways to do this- we can help you consider the options. Click here to book a free consultation

Divorce costs vary depending on how much you and your ex can agree. Just court fees – so you are looking just to have your divorce and you arrangements made legal, are (2025 prices) £612 to apply for divorce, an extra £313 for a financial order, and a further £263 for a child arrangements order.  At the other end of the scale, if there’s lot of conflict and disagreement and you both use lawyers, it can get very expensive. £30,000+ each is not uncommon. We can help you find ways forward that help reduce conflict and so reduce costs.  A fuller explanation can be found here

Yes, many couples do. Mediation, negotiation, and collaborative law are all ways to settle issues without a judge making the decisions for you. We can help you prepare for those discussions and keep things as calm and constructive as possible. Click here to book a free consultation

It’s wise to get early advice so you understand your options before making big decisions. Paying for a solicitor is not the only choice — we can help you explore other ways forward, such as mediation or support from a McKenzie Friend, if they’re a better fit for your budget and circumstances. The necessary legal steps for an uncontested divorce can be completed in 6 months. Where there’s disagreements over finances and child arrangements that need to be decided in courts, it can take much longer. Mediation is usually a quicker route. We’ll help you understand the likely timescales for your situation so you can plan for the road ahead. Click here to book a free consultation

Both partners may have a right to stay in the family home until a financial agreement is reached, but this may not be ideal. We’ll help you explore alternatives if living together has become difficult. Click here to book a free consultation
